The victim from Kandhamal in Odisha is from the Scheduled Castes (SC). Last year, a boy raped her repeatedly. He did not tell anyone anything due to threats. When his health started deteriorating, his mother took him to the doctor. After this, a case of rape came up.
On February 11, the victim’s parents lodged an FIR. The girl underwent medical examination. The investigation revealed reports of pregnancy and health problems related to it. The matter then reached the Surisa High Court, where the girl’s father sought permission for abortion. He said that pregnancy threatens the life of the girl child.
Medical board said- Pregnancy threatens the life of the girl child Last month, the court ordered the MKCG Medical College of Balrampur to be made a medical board to investigate the girl. The board told the court that pregnancy would be a serious threat to the girl’s physical and mental health.
After the report, the state government did not object to the petition. The government said that forcing the girl to have a child would be a violation of their fundamental rights under Article 21 of the Constitution. After this, the court allowed abortion.
The court also directed the Odisha government to create a standard operating procedure (SOP). The court said that the government should ensure that the treatment of the girl is properly. Bureaucracy does not become an obstacle and the law -enforcement agencies handle it better. The court ordered the SOP to be implemented within 6 months.
The 27 -week pregnancy, the rule of abortion is pregnant for more than 27 months, a 24 -week -old victim, which is more than the 24 -week limit. But in certain cases in the MTP Act, abortion is allowed even after 24 weeks, including minor and rape victims.
