A model has come to light regarding the provision of parental consent for opening accounts of minors on social media. According to IT Ministry sources, OTP will be sent to the mobile phones and emails of parents of children below 18 years of age.
This OTP will be generated on the basis of digital ID cards of children and parents already present in the digital space. Through this, the data of children or parents will not be made public. Permission regarding age and confirmation can also be taken from the parents.
According to Dainik Bhaskar sources, the parent’s permission will not be permanent. When they feel that their permission is being misused or that the permission has been taken fraudulently, they have no knowledge about the permission. In such a situation, they will also be able to withdraw the permission.
In fact, on January 3, the Central Government has prepared the draft of rules under the Digital Personal Data Protection Act (DPDP), 2023. Under this, now children below 18 years of age will be required to take the consent of their parents to open an account on social media.
Responsibility will lie with social media companies In the Data Protection Act 2023 issued by the Central Government, the responsibility of obtaining parental consent for opening accounts of children below 18 years of age has been given to social media companies only.
OTP model is considered to be the safest solution till now. According to an estimate, about 15 crore children under the age of 18 years are on social media in the country.
How will the age of underage children be confirmed? After the draft of the rules of the Data Protection Act came out, there are many apprehensions regarding the question of parental permission for children. However, the government has sought objections and suggestions in this regard till 18th February.
- If the parent’s own social media profile is not based on any verifiable document, then how will the age of their children under 18 years of age be confirmed.
- Children’s SIM card should be in their parent’s name only and thus there should be no questions regarding their age.
- If the children declare their age to be more than 18 years while opening the account, then what would be the need for the provision of parental consent.
- During the receipt of OTP, children under 18 years of age can complete the process of parental consent themselves by keeping their parents’ mobile with them.
- There is a possibility of information about important documents like Aadhaar required for obtaining parental consent while opening an account, getting exposed in the open space of social media.
DPDP law was passed in October, 2023 The Digital Personal Data Protection (DPDP) Act was passed by Parliament in October 2023. After the implementation of this law, people got the right to ask for details about their data collection, storage and processing.
