The Supreme Court on Monday stayed the trial court proceedings in the ongoing defamation case against Rahul Gandhi. The bench of Justice Vikram Nath and Justice Sandeep Mehta has issued a notice to the Jharkhand government and the BJP leader and sought their response.

During a speech in Chaibasa, Jharkhand before the 2019 Lok Sabha elections, Gandhi had called Shah a murderer. After this, BJP worker Naveen Jha had filed a defamation case against Rahul Gandhi for making derogatory remarks against Amit Shah in 2019.
During the hearing, Rahul’s lawyer Abhishek Manu Singhvi argued that many judicial decisions have said that only the aggrieved person can file a criminal defamation complaint. The complaint was filed on behalf of a third party. Doing so is not acceptable in a defamation case.

Even in 2018, in the Congress session held in Chaibasa, Rahul had said, ‘Any murderer in BJP can become the national president. At that time Shah was the national president of BJP. After this statement of Rahul, BJP Yuva Morcha State Vice President Pratap Katiyar had filed a case in the CJM court of Chaibasa.
The case was transferred to Ranchi MP-MLA court.
The case filed in Chaibasa was transferred to Ranchi MP-MLA court for hearing. Later, after the MP-MLA court started in Chaibasa, it was again transferred to Chaibasa. During the hearing here, Justice Rishi Kumar rejected the petition filed by Rahul Gandhi and gave notice to appear.
