Ministers in MP have the right to transfer, will be able to transfer under these rules

Madhya Pradesh government has given the right to transfer ministers in special circumstances. Transfers can take place in cases of serious illness, court orders, or administrative necessity. No transfer will take place pending disciplinary action. The ban on general transfers will be lifted after the release of the policy in April-May.

State Bureau, Naiduniya, Bhopal: Even though the state government has given transfer powers to the ministers, they too will not have a free hand. Ministers will be able to transfer only in case of serious illness, complaint and court cases.

Transfer can be done on administrative grounds but it must be kept in mind that there should not be a vacancy situation in the place from where the transfer is being made. Due to transfer policy not being issued, transfers were not taking place in the state.

Cases were being sent by departmental ministers in coordination with the Chief Minister but not much permission was being given. Many cases of other categories including serious illness were pending, due to which administrative work was also being affected.

Transfer in special cases

On the demand of the ministers, with the permission of Chief Minister Dr. Mohan Yadav, the right to transfer in special cases has been given to the ministers through amendment in the transfer policy. Now there is a provision in this that transfer will be allowed in cases like cancer, paralysis, heart attack.

Also, the transfer will be carried out in compliance with the court order but it will definitely be seen whether any disciplinary action is pending. If so, then transfer will not take place.

Transfer can be made in such cases of irregularities and negligence in which disciplinary action has been initiated under the Madhya Pradesh Civil Services Rules, 1966.

Transfer can also be made with a view to ensure that the investigation is not affected if a criminal case is registered against a government servant or prosecution proceedings are initiated by the Lokayukta Organisation, Economic Offenses Investigation Bureau or the police.

Transfer on administrative grounds

The vacancy caused by suspension, resignation, retirement, promotion, withdrawal from deputation or death of a government servant can also be filled during the period of ban on transfer. If a vacancy is created at the concerned place due to transfer on administrative grounds, then transfer will not be possible there.

Possible to issue transfer policy in April-May

Departmental secretaries will be able to make high priority transfers from the Chief Minister’s Office with administrative approval. Transfer can also be made if the duration of a project is completed or the post is transferred elsewhere. Ministry sources say that the ban on general transfers will be removed by issuing the transfer policy in April-May.
