The Madhya Pradesh government has made strict rules after the cases of children falling in open borewells. This is probably the first case in the country, where a provision has been made strict when the open borewell cases are revealed. According to the Public Health Engineering Department, tubewells or borewells that do not have water will have to be closed immediately.

Saurabh Soni, Naiduniya Bhopal: If there is an accident due to leaving the borewell open in Madhya Pradesh, then the person responsible for the landlord and the mining agency can be imprisoned and imprisoned for two to 10 years under the Indian Justice Code.
Borewell or tubewell mining will have to be obtained online from the Public Health Engineering Department. Failure to do so has been provided for penalty and imprisonment.
If unsuccessful borewells are not closed, then a fine of Rs 10,000 will be imposed on the concerned agency for the first crime and 25 thousand rupees for every crime.
Such sign board will have to be installed near borewell
- Near the borewell, landlord and mining agency will have to install a sign board with contact number, full address details. These rules have been made under the prevention and security of accidents due to falling of children in open borewells.
- Notification of new rules has been issued. According to officials, Madhya Pradesh is probably the first state to make such a stringent rules. According to this, security measures will have to be taken to ensure that there is no accident due to borewell digging.
- To place prickly fences or other obstructions around the mining site. The concrete platform has to be constructed around the casing pipe. Welding will have to be closed by a strong lid of the steel plate on the casting pipe by welding.
- In the new law, any person will be able to complain against the person who has done borewell mining without permission. The complainant will be rewarded if the complaint is found correct.
Act enacted after Supreme Court directive
The Supreme Court on February 11, 2010 and August 6, 2010, to prevent the deadly accidents of children falling in open or incomplete borewells, that such accidents should be prevented by making laws. In the same sequence, the state government introduced a bill in the assembly and implemented ‘Prevention and Security of accidents due to falling of humans in open tube wells in July, 2024.
Now notification of its rules has been issued. Action will be taken against those who do not follow this in various sections of the Indian Justice Code, Indian Civil Protection Code, Madhya Pradesh Land Revenue Code, 1959 and the General Section Act, 1957.
The mining agency will have to give this information on the portal
- Jio tag photos of safety measures taken during digging will have to be uploaded.
- After the completion of the digging, depth, result, functionality and unsuccessful tubewells, borewells are appropriately sealed, covered with its live tag photo.
