The Madras High Court while hearing a case on Tuesday (March 11) said that God will forgive us by building a metro station on the temple land. The judge said that finally the devotees of God will also benefit from this. With this comment, the High Court allowed the land of two Hindu temples to be acquired to build the station of Chennai Metro Rail Limited (CMRL).

Justice N Anand Venkatesh said that such a project, which can benefit millions of people, will surely be fulfilled by divine grace. The court said that the land of religious institutions can be acquired for public projects. The judge said, “Acquisition of land of religious institutions under the jurisdiction of the state is not a violation of fundamental rights under Article 25 or 26 of the Constitution.”

The court cited the decision of the Kerala High Court in the Balakrishna Pillai vs India Union case. It said that if religious institutions are affected for the national highway, God will forgive. Justice Venkatesh reiterated it and said that if the land of the temple is acquired to build a metro station, then God will forgive, because it will also benefit the devotees of the temple.

Judge Venkatesh said, “This court strongly believes that Ishwar will show his kindness and kindness to build a metro rail station, which will benefit millions of people of all sections of society. Some of these can also be devotees who go to the temple. God will forgive us. God petitionersWill also protect the authorities and the author of this decision. God will be with us. “

The CMRL wanted to acquire the land near Ratina Vinayagar Temple and Durgai Amma Temple to build a metro station. It was opposed by the devotees of the temple. After this, the Alayam Kapom Foundation filed a PIL (PIL) against the acquisition. To this, Chennai Metro said that it can overcome the land on the other side, where the United India Insurance Company is the headquarters of the Insurance Company.

After this, the first bench of Madras High in view of the new proposal of CRL Pil closedMeanwhile, United India Insurance opposed the proposal to acquire his land and challenged it in the High Court. He argued that he is not a party in the PIL and has invested Rs 250 crore to build this headquarters after taking a No Objection Certificate (NOC) from CMRL.

The Madras High Court accepted the argument of this insurance company as reasonable and said that in fact the 5th defendant (Alayam Kapom Foundation representing temple devotees), CMRL and state authorities took the decision of the main character (United India Insurance). In fact, the insurance company said that CMRL had talked about the acquisition of its land in the court without its knowledge.

The court termed the acquisition of land of the insurance company against the principle of natural justice. Court said, from the original plan Durgai Amma Temple There will be a shortage of some space for devotees. Also, during the construction work, the temple’s gopuram (entrance) and one deity must be transferred to another area, but Gopuram and the deity can be restored after the construction is completed.

Finally, the court accepted the petition of United India Insurance and quashed the land acquisition notice against its property. Justice Venkatesh also dismissed the argument about the inspection of the High Court judges citing a violation of natural justice. He said that CMRL is free to proceed with its original acquisition scheme.
