Atul Subhash’s mother got a shock from SC, she did not get the custody of her grandson, the child will remain with the mother.

Engineer Atul Subhash’s mother has received a setback from the Supreme Court regarding the custody of her grandson. The court said that the child will remain with his mother. The Supreme Court rejected the demand of Atul Subhash’s mother. However, the court has given permission to Atul Subhash’s mother to approach the lower court to demand the custody of the child. Atul’s mother Anju Devi had demanded the handing over of her 4-year-old grandson.

In the petition, Atul Subhash’s mother said that Nikita and her family harassed Atul for money by implicating him in a false case. Due to this he had to commit suicide. Now Nikita Singhania’s family is creating obstacles in finding the child. Atul’s son is not safe with him.

A bench of Justice BV Nagarathna and Justice Saish Chandra Sharma heard the plea of ​​Anju Devi, who had filed the petition seeking the custody of her four-year-old grandson.

On January 7, the court had also refused to grant him the custody of the minor child, saying that he was a stranger to the child. The top court had said, “Regret to say this, but the child is a stranger to the petitioner. If you wish, please meet the child. If you want the custody of the child, there is a separate procedure for that.”

During the hearing, the lawyer appearing for Subhash’s estranged wife Nikita Singhania told the top court that the child is studying in a boarding school in Haryana.

The body of 34-year-old Atul Subhash was found hanging in his house in Munnekolalu, Bengaluru on December 9 last year. He had reportedly left long messages in which he blamed his wife and in-laws for forcing him to commit suicide.

34-year-old Subhash, a deputy general manager in a private company, hanged himself in Bengaluru on December 9, 2024. Earlier, he had also written a video and a 24-page suicide note. In this note, his wife Nikita Singhania (living separately) and her in-laws were accused of harassment.

The Singhania family was later arrested for abetting Subhash’s suicide and granted conditional bail on January 4.

Subhash’s wife and in-laws were arrested by Bengaluru Police in December last year. Based on the complaint of the deceased’s brother, a case was registered against Subhash’s wife Nikita Singhania, her mother Nisha Singhania and brother Anurag Singhania under section 108 (abetment of suicide) of the Indian Justice Code (BNS).

During police interrogation, Nikita claimed that it was Atul who used to harass her. He had approached the Bengaluru sessions court for bail in the case.

Earlier in December, Allahabad High Court had granted anticipatory bail to Nikita Singhania’s uncle Sushil Singhania. His name was also included in this case.
