The Allahabad High Court has directed the Uttar Pradesh government to bring a policy that prevents the private practice of the doctors posted in the state hospitals. Justice Rohit Ranjan Aggarwal expressed concern in the matter, saying that today it is a big problem that the patient goes to a government hospital for treatment and he is referred to a private institution.
The court said, “It has become a threat that patients are being referred to private nursing homes and hospitals for treatment and doctors appointed in provincial medical services or state medical colleges by the state government are not treating and taking care of patients. They are being referred to private nursing homes and hospitals only for money. ”
It is worth noting that the court passed this order on a petition related to Dr. Arvind Gupta, Head of Department and Professor of Motilal Nehru Medical College, Prayagraj. A patient had complained to the State Consumer Forum against Dr. Gupta that he sent the patient to a private nursing home and he was treated there wrongly. After this he reached the High Court.
After this, the matter came up before the court on 2 January. The court first questioned whether Dr. Gupta can be allowed to treat patients in private facilities despite being in government service? After this, the court had also ordered the state government to investigate how the government doctors are doing private practice.
The court also said at that time, “This is a serious matter. The state should also check about government doctors who have been practicing private practice in nursing homes and medical shops, who have been appointed in various state medical colleges. ”
On January 8, the court, citing the 1983 rules by the Principal Secretary of Medical Health and Education, was informed that these rules prevent doctors working in government health institutions from doing private practice. There government lawyer It was said that on 6 January, all the District Magistrates have been issued instructions to follow the mandate of 30 August 1983 to stop private practice, in the districts where the medical college is located. The court has sought an affidavit from the Principal Secretary to implement this.
Only after this, the court asked the Principal Secretary to file a personal affidavit on the implementation of the rules. The court directed the Principal Secretary Medical Education and Health to file a personal affidavit by giving details of the enforcement of the orders of 1983. Along with this, the state government was also instructed to formulate a policy so that all government doctors could be banned on private practice. Now the next hearing of this case will be held on 10 February.
