Bangladesh’s appeal to India: Is Sheikh Hasina’s extradition possible? , News & Features Network

New Delhi: Bangladesh The demand for Sheikh Hasina’s extradition, an issue that has created a stir in diplomatic relations between India and India, has sparked a new debate in political circles. Bangladesh has made an official request through a note verbale to bring back former Prime Minister Sheikh Hasina from India. However, India has not yet clarified its position on this. This matter is raising big questions regarding the internal politics of Bangladesh, India-Bangladesh relations and regional stability.

Events of Sheikh Hasina’s presence in India

On 5 August 2024, a massive student movement began in Bangladesh, with intense protests against the government of Sheikh Hasina. When the situation worsened, Sheikh Hasina left the country and took refuge in India. Meanwhile, Nobel laureate Mohammad Yunus took power in Bangladesh. Yunus not only soured relations with India but also gave priority to the demand for Sheikh Hasina’s extradition.

Bangladesh’s official request: a formality or pressure?

On 23 December, the Bangladesh High Commission in New Delhi requested the extradition of Sheikh Hasina through a “note verbale” to the Indian Ministry of External Affairs. This is the lowest level of the diplomatic process and is generally not considered appropriate for such sensitive issues.

Sources say Bangladesh has not completed the necessary formalities to proceed with the extradition request. This carelessness makes it appear that Bangladesh is stirring up the issue only for political gains at the domestic level.

India’s response: Silent so far

India has not yet given any official response on this issue. However, it is believed that India may disappoint Bangladesh in this matter. Experts believe that the decision on extradition depends on legal, diplomatic and political aspects.

Extradition Treaty: A Big Challenge

An extradition treaty was signed between India and Bangladesh in 2013, which contains several conditions and exceptions.

  1. Political crime exception: Under Article 6, extradition may be refused if the crime requested is political in nature.
  2. Impartiality of judicial process: According to Article 8, extradition may be refused if the request is malicious or not in the interests of justice.

Legal options and Hasina’s status

Sheikh Hasina has legal options available, which she has not been able to use till now. If India considers this request, the matter may go to court.

Bangladesh politics and pressure on India

It is believed that the Mohammad Yunus government wants to pacify its domestic voters, especially students, through this demand. Yunus and his government have consistently adopted an aggressive stance against India, which is worsening relations between the two countries.

Current scenario of India-Bangladesh relations

Relations between Bangladesh and India have become tense under the leadership of Mohammad Yunus. The situation is also worsening on the economic and security cooperation front. India has shown restraint so far, but Bangladesh’s aggression may pose a challenge in maintaining this for a long period.

What will be the next step?

  1. India’s stance: India taking a clear stand on the extradition request could be a turning point in the matter.
  2. Legal Complications: If the case goes to court, it could take months or years.
  3. Political pressure: Pressure from the Bangladesh government and the international community may influence India’s decision.

Conclusion: New chapter in relationships or growing conflict?

The issue of Sheikh Hasina’s extradition is not just a diplomatic dispute but a test of relations between India and Bangladesh. India’s next move will determine regional stability and the future of both countries.
