Odisha High Court said- Relationship not to change in marriage, not crime, law does not give protection every promise
The Odisha High Court dismissed the allegations of rape on a person. The person was accused that he had a false promise of marrying the woman for about nine years.
Justice Sanjeeb Kumar Panigrahi’s single bench said in the judgment that not changing the marriage of love relationship can be the cause of private complaint, but it is not a crime. Failure in love cannot be considered a crime.
Justice Panigrahi said, “The law does not give protection to every broken promise nor does every unsuccessful relationship under the purview of crime.” Both were adults and were free to decide or not to have a relationship with their will. In such a situation, the charge of rape is not legally correct.
