High Court: Why the FIR was not registered even when the magistrate investigation came to light.

Senior Advocate: The government is conducting an independent inquiry into the case. Accidental Death Report (ADR) was filed in the case and CID is investigating it.

High Court: Can only check on the basis of ADR, where is the FIR. Is ADR itself an FIR? Initially, the ADR is recorded, but when it comes to the case that it was not an accidental or natural death but murder, then the FIR should not be registered. What will CID do after the investigation is completed.

Senior Advocate: On completion of the investigation, the CID will file a final report as per the rules fixed. These can also be a closure report and also the process sheet.

After this, the court reserved the verdict whether FIR should be made on those five policemen based on the report of the magistrate investigation or not.

Magistrate investigation suspects police claims Akshay Shinde, accused in the Badlapur sexual abuse case, died on September 23, 2024 in a police encounter. He was arrested in August for sexual harassment of two minor girls in a school toilet in Badlapur, Thane.

In the report, the magistrate agreed to the accused of the accused’s father of fake encounter and doubted the claims of self -defense of the policemen. In the report, five policemen were held responsible for the death of the accused.

Accused Akshay’s mother refused to take the body The mother of accused Shinde had said after the encounter that we kept waiting for hours in the hospital, but the policemen did not even let us see Akshay’s body.

After the incident, both the girls were afraid of going to school. When the parents of a girl were suspicious, they questioned the daughter. After this, the girl told the whole thing. Then the girl’s parents spoke to the parents of another girl. This was followed by a medical test of both the girls, in which sexual abuse was revealed.

When the family of both the girls reached the police station to register a case, the police also defrauded to register an FIR. The victims’ families sought help from social workers. Two days later, the police filed a complaint late on August 16. The accused was arrested by the police on 17 August.

People had stopped trains, stoned police

On August 20, the protesters opened the main gate of the school and vandalized and vandalized.

The state government suspended 3 policemen, including the women police inspector of Badlapur police station, on charges of delay in registering the case. Also, some school staff including the principal were also suspended.
