Video of the time of water filling in the basement of Rau Coaching Center on 27th July. An eyewitness said that the flow was so strong that it was difficult to climb the stairs. Within a few seconds the water was knee deep.
On the night of 27th July, 3 students died due to water logging in the basement of Rau IAS Coaching Center in Old Rajendra Nagar, Delhi. In this case, Delhi High Court has granted bail to all four owners of the basement.
Justice Sanjeev Narula said that we agree with the accused that they are only the owners of that property. He had no role in the students drowning due to water filling the basement.
The judge has also said that no such evidence has been provided in the status report or anywhere else which could make a case of corruption against the four co-owners Parvinder Singh, Tajinder Singh, Harvinder Singh and Sarabjit Singh.
In such a situation, relief can be given to the accused. Along with this, the court converted the interim bail given to the four accused into regular bail on September 13, 2024. The court had given this order on January 21, which has now come to light.
On July 27, 2024, the basement of Rau IAS, where the library of the coaching center was, was flooded. Three students lost their lives due to drowning.
Trial court will decide whether renting basement is a crime or not
The court said that investigation in this case has been completed and charge sheet has been filed. However, the allegations made are of a serious nature. But we have to pay attention to the role of the basement owners mentioned in this.
The court said that the four co-owners are accused of renting out the basement for commercial use, for which permission was not given. However, it is for the trial court to decide on the basis of evidence whether renting out the basement would constitute an offense under Sections 105 and 106 of the BNS.
The owners of the basement had said that the basement was not given to make a library.
On August 12, the bail plea of four co-owners was heard in Rouse Avenue Court. Then the court had asked the accused whether you had given certificates of rights to the basement to the tenants?
This But the accused’s lawyer Amit Chadha had replied that it is a commercial property. It was given on rent for commercial use or as a coaching institute. It was not given for use as a library.
The counsel for the accused also mentioned the fire safety certificate of the building. This certificate was issued on 9 July 2024 for three years.
After the accident in this coaching center located in Old Rajendra Nagar, Delhi, students demonstrated for several days demanding justice.
Understand how students drown in 6 points
- On the night of 27th July, due to power cut in the building, the biometric gate of the basement library got jammed. Students got trapped inside the library in the dark.
- Initially water did not enter the basement due to the gate being closed, but after a few minutes the water pressure increased and the gate broke.
- Eyewitnesses said that after the gate was broken, water started filling the basement rapidly. The flow was so strong that it was difficult to climb the stairs.
- Within a few seconds the water was knee deep. In such a situation, the students stood on the bench. In just 2-3 minutes the entire basement was filled with 10-12 feet of water.
- Ropes were thrown to save the student, but the water was dirty, so the rope was not visible. Benches were also floating in water. Therefore there were problems in rescue.
- Bodies of 3 students were found late at night. 14 children were rescued safely with the help of ropes. When the rescue was in the final stages, there was still 7 feet of water inside.
Supreme Court had said – Coaching institutes have become death chambers
The hearing was held in the Supreme Court on 5 August. The bench of Justice Surya Kant and Justice Ujwal Bhuiyan described the coaching centers of Delhi as death chambers. The bench had said- We are concerned about the safety of the coaching setters. Coaching centers are playing with the lives of children. The court issued a notice to the Central Government and the Chief Secretary of Delhi asking whether safety rules have been implemented in the coaching centres?
