To prevent vulgarity on social media, the central government is working on replacing Digital India bill in place of the current IT Act. The new law will have provisions to regulate U Tuber, Digital Platform and social media users.
The Center has been working on the Digital India bill for about 15 months. Laws with specific provisions for different areas will be enacted. For example, different provisions will be kept for telecommunications, information technology and information and broadcasting subjects. There should also be a system of governance of artificial intelligence.
The government is returning to the Digital India Bill due to the dispute of social media influencer Ranveer Alahabadia. However, AI governance has decided to keep it aside. This requires a completely separate regulation.
The government has to give a satisfactory answer to the Supreme Court immediately to give a satisfactory answer to what is being done to remove the flaws of the IT Act. The Parliamentary Committee on IT affairs has also demanded a response from the government to curb pornographic content.
Ranveer Alahabadia made a controversial remarks during the India’s Got latent show on 8 February.
The IT Act was formed in the year 2000, then there were 60 lakh net users, now 90 crores The IT Act, 2000 is old. Internet users in the country were up to 60 lakhs when it was made. Now there are more than 90 crores. The Parliamentary Committee had recently asked the government on pornographic and fuel content what provisions regarding such content in the IT Act. The Supreme Court has also called the Attorney General and Solicitor General on the next hearing on the same issue.
Government’s guideline regarding content In 2021, the Government of India created the Rules Rules, The Information Technology (Intermediary Guidelines and Digital Media Ethics Code). It was updated on 6 April 2023. The 30 -page guidelines mention the rules for social media, film and web series.
Page number-28 has general guidelines for the film, web series and entertainment programs. In this, it is necessary to decide the category based on target audiences. It is also important to warn what content you are showing.
According to guidelines, Grevens officers have to be kept on OTT and social media platforms. Content should be according to the law. There should be no sex, no anti nation and there is no harm to children and women.
There are two types of rules for its monitoring… first: There should be self -regulatory. Meaning the content uploading will take care of the government’s guidelines. For this, social media platforms, OTT, mobile apps will take care of them themselves. They will check if any content is wrong. There should be no child pornography. They will also see what level of sexual content is and what is the language.
Second: If someone has objections to the content, then he can complain. For this, there will be a system to complain on the platform, website, app publishing content. He will have the name, phone number and email ID of the Grevens Officer. Any person will be able to complain to him.
The complaint officer will register a complaint in 24 hours. The complainant will have to give an anamentment. It has to be resolved within 15 days from the date of the complaint. If the content needs to be removed, it has to be removed. If the complaint is not heard, then you can also complain on the website of the Ministry of Information Broadcasting.
Celebrity caught in porn content case Ranveer Alahabadia and Time Raina: Ranveer Alahabadia was accused that he had made obscene comments on parents in Raina’s show ‘India’s Got Letant’. After this, FIRs were lodged against him at many places including Maharashtra, Assam. Time in the case is also registered against Raina and Apoorva Makhija. The matter is currently in the Supreme Court.
Raj Kundra: On July 19, 2021, the Mumbai Police arrested Raj Kundra, husband of actress Shilpa Shetty, for making porn films and distributing her from the website-application. Mumbai Police said that the Crime Branch had registered a case in February 2021. There is enough evidence of Raj Kundra’s involvement in this case.
In this case, 12 accused including Kundra were arrested. Police told the court that ‘Raj Kundra was dealing with pornographic videos through his app hotshot’.
Ekta Kapoor: On October 22, a case was registered against film maker Ekta Kapoor and her mother Shobha Kapoor under the Poxo Act in Borivali, Mumbai. He was accused of showing pornographic content related to minors in the web series ‘Dirty Baat’ of OTT platform ‘Alt Balaji’. The series was shown between February to April 2021.
Ekta Kapoor is the founder of Alt Balaji. However, his company then Alt Digital Media Entertainment Limited said that the company fully follows all laws.
Ban apps getting video on telegram On March 12, 2024, the Ministry of Information Broadcasting blocked 18 OTT platforms showing pornographic content. Apart from these, 19 websites, 10 apps and 57 social media accounts related to them were also closed. The names of all 18 OTT platforms were also given in the ministry’s press note. It was written in the press note that now they cannot be accessed anywhere in India.
Our investigation revealed that the website and OTT platforms are closed, but 11 of the 18 apps banned are now being found on the telegram. Channels have been made under the name of the app, on which videos have been posted even after March 2024. A separate mobile app is being downloaded to play video. These apps have been uploaded on these apps till 16 February 2025.
Complaint against Netflix, Alt Balaji and X also Former Central Information Commissioner Uday Mahurkar has raised the issue of pornographic films on social media and OTT in court. In a conversation with Dainik Bhaskar, he explains, “We had complained to the Delhi Police against Netflix, Alt Balaji and X (now Twitter).”
Uday Mahurkar says,
FIR was not registered on our complaint. Then I went to Saket court. The case will be heard on March 6, 2025. The court has also called the Delhi Police to respond.
Uday Mahurkar further says, ‘Full porn content is being shown on two OTT platforms, not obscene. These platforms are ignoring the guidelines of the Government of India.
