Atul Subhash’s mother has not got interim relief from the Supreme Court in the grandson’s custody case. The Supreme Court has refused to allow him to meet the child. The Supreme Court said that the grandmother is a complete stranger to the child. The Supreme Court sought an affidavit from Nikita and the Haryana government. Now the next hearing in this case will be on January 20. The Supreme Court has made a big comment during the hearing. Justice BV Nagarathna said that the case will not be decided through media trial. It has to happen through a trial in the court.
Question on the petition seeking custody of the child
Nikita Singhania is yet to be proven guilty. The court raised questions on the petition of Atul Subhash’s mother seeking custody of the child. The Supreme Court said that the child has spent very little time with the grandmother. In a way, he is a stranger to the grandmother, we are only on the issue of custody in this case. Actually, Nikita was declared guilty on behalf of Atul Subhash’s mother. On which the Supreme Court expressed displeasure and said that the matter is currently in the Bangalore court. Let the law take its course.
What did Atul Subhash’s wife’s lawyer say?
The lawyer on behalf of Atul Subhash’s wife Nikita said that earlier she was in jail under judicial custody. Now she has come out of jail. Today itself he has taken the custody of the child, as per the condition he has to appear before the investigating officer every Saturday. She will take the child with her to Bangalore. In the case of Atul Subhash’s suicide, his mother has reached the Supreme Court. A petition has been filed regarding the custody of Atul Subhash’s four-year-old son. A demand has been made to summon Atul Subhash’s son to the court.
Grandmother demands custody of grandson
In the last hearing, the Supreme Court had issued notice to the governments of Uttar Pradesh, Haryana and Karnataka on this Habeas Corpus petition. In the Supreme Court, the bench of Justice BV Nagarathna and Justice N Kotishwar Singh heard the case and issued notice to the three states. Anju Modi, mother of petitioner Atul, has filed a habeas corpus petition, applying for the custody of her grandson i.e. Atul’s four and a half year old son. This petition has been filed by advocate on record Kumar Dushyant Singh while it was argued by senior advocate Gaurav Aggarwal.
What did Nikita tell about his son?
It has been said in the petition that no one knows where the child is, because Atul’s wife Nikita, who is in custody, is not revealing the whereabouts of that child. Wife’s brother Anurag Singhania and mother Nisha Singhania are also currently in custody. Therefore, after interrogating them, the custody of the innocent child should be handed over to them i.e. the grandparents. Nikita told the police that the son is studying in a boarding school in Faridabad, his custody is with Nikita’s uncle Sushil Singhania.
Whereas Sushil has completely denied the police having custody of the child or having any information about him. Because this matter is related to the three states of Uttar Pradesh, Haryana and Karnataka. Therefore, the Supreme Court should intervene in this. The child should be recovered and brought before the court.
