Tahir Hussain has 11 FIRs on Delhi riots. Tahir is also in custody in UAPA and Money Laundering case.
A 3 -judge bench of the Supreme Court will hear the bail plea of Tahir Hussain, former councilor and accused of Delhi riots today. The bench of Justice Vikram Nath, Justice Sanjay Karol and Justice Sandeep Mehta will hear the petition of Tahir Hussain.
Tahir has filed a bail petition in the Supreme Court to campaign in the Delhi elections. On 14 January, the Delhi High Court had given a custody parole to Tahir to fill the nomination from Mustafabad seat and dismissed the bail plea for election campaign.
He has been made a candidate from Mustafabad by Owaisi’s party AIMIM. He has been in jail for 4 years and 9 months on charges of Delhi riots.
On 22 January, Tahir’s bail plea could not be agreed in the bench of 2 judges of the Supreme Court. Justice Ahsanuddin Amanullah was in favor of granting bail to Tahir, while Justice Pankaj Mittal dismissed the petition.
Justice Mittal had said- Giving bail will open the box of Bhanumati
Justice Mittal had said that if given interim bail to contest elections, it will open Bhanumati’s box. Elections are held throughout the year. Every prisoner will bring arguments that he be granted bail to contest elections. Justice Ahsanuddin Amanullah had said that the accused has been in jail since March 2020. He should be granted bail for publicity.
On behalf of Delhi Police, Additional Solicitor General SV Raju had said in the court that Tahir is also an accused in UAPA and Money Laundering. Even after getting bail in this case, he will have to stay in jail. Because there is no interim bail for election campaign in the UAPA case.
Supreme Court- Ban on contesting from jail
During the hearing in this case on January 20, the Supreme Court had said that all the jailed people should be prevented from contesting elections. Advocate Siddharth Aggarwal, presented by Tahir, requested the court to hear on 21 January.

Now they sit in jail and contest elections. It is easy to win the election by sitting in jail. All of them should be prevented from contesting elections.
Tahir is also accused of inciting riots, using home and office roof for riots and killing IB officer Ankit Sharma.
High court gave custody parole for nomination
Tahir is accused of killing IB officer Ankit Sharma on 25 February 2020 during the Delhi riots. Tahir had sought interim bail from the High Court from 14 January to 9 February for campaigning. On 13 January, the High Court said that the nomination could also be filled by jail.
On this, Tahir’s lawyer Tara Narula argued that engineer Rashid was granted interim bail for election campaign. There is also a case of terror funding against him.
Tahir has been nominated by a national party. They are ready to give details of all their properties. He also has to find a proposer for himself and the election process has started in Delhi.
The trial has started in the case and so far 20 of the 114 witnesses have been questioned. In such a situation, the trial is not expected to be completed soon. Tahir has been in custody for more than 4 years and 9 months.
The High Court approved Tahir’s custody parole on 14 January. On January 16, Tahir came out of Tihar Jail amid tight security and went back to jail after filing nominations. After this, Tahir reached the Supreme Court for bail.

Apart from Tahir, 15 people including his brother Shah Alam were accused. In the charge sheet, Delhi Police had said that Tahir Hussain was on the roof of his house at the time of violence and the violence erupted due to it.
Tahir used his license pistol in the riots. According to the police, Hussain had taken out his pistol deposited at Khajuri Khas police station just a day before the riots. During the investigation, the police seized the pistol.
