Hearing in Supreme Court today on farmers’ movement: 2 petitions for opening Shambhu border, hospitalizing Dallewal; Punjab government will give compliance report – Patiala News

Farmer leader Jagjit Dallewal has been on fast unto death for 42 days at Khanauri border.

There will be a hearing in the Supreme Court today regarding the farmers’ movement that has been going on for 11 months on the Shambhu and Khanauri border of Haryana-Punjab. In this, two cases will be placed before the court. The first case is the Haryana government’s complaint against the Punjab and Haryana High Court’s decision to open the Shambhu border.

Secondly, there is a contempt petition against the Punjab government for not admitting farmer leader Jagjit Dallewal, who was on hunger strike for 42 days at the Khanauri border, to the hospital. In this, the Punjab government will present the compliance report before the court regarding hospitalization of Dallewal. In the last hearing held on January 2, the Supreme Court had asked to keep both the cases together.

On Saturday, after addressing the Mahapanchayat for 9 minutes, Dallewal started feeling dizzy and vomiting. His blood pressure dropped considerably. After which the health department has put a team on alert mode.

Meanwhile, farmer leader Sarwan Pandher said that we will celebrate the Prakash Parv of Shri Guru Gobind Singh Ji on January 6 at the Shambhu border itself.

How the matter of opening Shambhu border reached the Supreme Court, 5 points

1. Farmers’ agitation is going on at Shambhu border from 13 February 2024 regarding the law to guarantee minimum support price (MSP) of crops. Apart from this, farmers are also protesting at Khanauri border.

2. On July 10, 2024, the Punjab and Haryana High Court had ordered that the Shambhu border should be opened within a week. The Haryana government went to the Supreme Court against this.

3. Hearing took place in the Supreme Court on 12 August 2024. Supreme Court asked to open one lane of Shambhu border for ambulance, senior citizens, women, students. During this time the Supreme Court formed a committee. Who was to mediate between the government and the farmers.

4. This committee of the Supreme Court was formed under the chairmanship of retired Justice Nawab Singh of Punjab and Haryana High Court. Which includes former DGP BS Sandhu, agricultural analyst Devendra Sharma, Professor Ranjit Singh Ghuman, agricultural informaticist Dr. Sukhpal Singh and special invitee member Professor Baldev Raj Kamboj.

5. The committee submitted its interim report to the Supreme Court on December 10. In which he said that the agitating farmers are not coming for talks. The date and time as per their convenience were also asked from the farmers but no response was received from them. The farmers refused to attend the subsequent meeting.

In Dallewal’s case, 7 hearings were held in the Supreme Court in 24 days.

1. Said on December 13 – Provide immediate medical help Dallewal was sitting on a fast on 26 November. On 13 December, a hearing was held in the Supreme Court regarding Jagjit Dallewal’s fast unto death. In which the Supreme Court asked the Punjab and Central Government to provide immediate medical help to Dallewal. They should not be force fed anything. His life is more important than the movement. After this, Punjab DGP Gaurav Yadav and Central Home Director Mayank Mishra reached Khanauri border and met him.

2. Said on December 17 – Punjab government should do something In this hearing, the Punjab government said in the Supreme Court that Dallewal should be admitted to the hospital. On this the Supreme Court said that there are sentiments attached to them. The state should do something. Laxity cannot be tolerated. You have to handle the situation.

3. Said on December 18 – Who can tell if a 70 year old man is okay without a test? remained In this hearing, the Punjab government claimed that Dallewal’s health was fine. On this the Supreme Court asked that the 70 year old man is on hunger strike for 24 days. Who is the doctor who is telling Dallewal to be right without any test? How can you say Dallewal is okay? When he was not examined, blood test was not done, ECG was not done.

4. Said on December 19 – Officials should take a decision on hospitalization In this hearing, the Supreme Court said that Dallewal’s condition is worsening every day. Why doesn’t the Punjab government make him shift in the hospital? This is their responsibility. It is the responsibility of the Punjab government to ensure the stable health condition of Dallewal. The authorities will take a decision if he needs to be admitted to hospital.

5. Said on December 28 – Shift the hospital with the help of the Centre. This hearing took place on a contempt petition filed for non-implementation of the Supreme Court’s December 19 order. In this, the court told the Punjab government that first you create the problem, then you say that you cannot do anything. Shift them to the hospital with the help of the centre.

In this, on the protest of the farmers, the court said that it has never heard of any movement to stop anyone from being taken to the hospital. This is like incitement to suicide. What kind of farmer leaders are they who want Dallewal to die? Pressure is visible on Dallewal. Those who are opposing his hospitalization are not his well-wishers.

6. On December 30, Punjab government was given 3 days’ extension. During this hearing, the Punjab government told the court that Punjab was closed on December 30, due to which the traffic did not move. Apart from this, if the central government takes initiative then Dallewal is ready for talks. After which the Supreme Court accepted the application of Punjab Government seeking time.

7. Said on January 2 – We did not ask to break the fast In this hearing the court said – Deliberate efforts are being made to worsen the situation. We never asked to break the fast. The court told the Punjab government that your attitude is not to bring about reconciliation. Some so-called farmer leaders are making irresponsible statements.

In this case, Dallewal’s friend advocate Guninder Kaur Gill had filed a petition to form a party. On this, Justice Surya Kant said, “Please do not think about confrontation, we cannot talk directly to the farmers.” We have formed a committee, we will talk to the farmers through the same committee.
