- Therefore, the UPSC candidates should allow the candidates to appear in the examination by giving a relaxation of five years. The last date for filling the form should not be spoiled due to Tuesday 18 February. If UPSC is putting so much emphasis, the High Court determines the final hearing of this case on 24 February.
What is the matter:
- The High Court in its former interim order had directed the UPSC to accept the applications of the petitioners and other similar nature candidates. The court had also imposed a condition that the results of these candidates who get the benefit of five years of age without permission should not be declared.
- On behalf of the petitioner Satna resident Aditya Narayan Pandey, senior advocates Kapil Sibal and Manish Singh presented the side through VC. He had argued that all other reserved categories SC, ST and OBC are exempted from age limit.
- EWS is also reserved category, so they should also be benefited. This is also because a few days ago, in Secondary and Primary Teacher Selection Examination-2024, EWS candidates were instructed to give the benefit of five years exemption in age limit.
- In fact, the Union Public Service Commission conducted the initial examination on 25 May 2025 for 979 posts and the main examination on 22 August 2025. The Commission has declared the examination schedule on 22 January. Forms are being filled from this day, which can be submitted by 18 February. In case of error in the application form, the candidates will be able to amend from 19 to 25 February.
- The case has been filed on behalf of Pushpendra Dwivedi and others resident of Rewa. Advocates Dheeraj Tiwari and Ishaan Soni appeared on his behalf. He argued that EWS was considered reserved category in Kandika 7.1 and 7.2 of the Rule Book of Teacher Selection Examination, but in Kandika 6.2 where other reserved classes (SC, ST, OBC) were given age exemption. The EWS class was excluded from discount.
- This petition was filed by challenging the constitutionality of the recruitment rule on this. The petition claimed that the age limit to the EWS class is not exempting the age limit of Article-14 equality of the Indian Constitution and Article-16 is a violation of the equality of opportunity in public employment.
