In the coming time, your children will neither be able to misuse social media without your permission nor will they waste more time than necessary on it. Actually, the Central Government is preparing to bring such rules, after the implementation of which children will have to take permission from their parents before creating an account on social media. Not only this, users will also have the option to withdraw their consent given regarding the data. The Central Government has released the draft of the Digital Personal Data Protection (DPDP) Act to implement these rules. It is being told that the rules mentioned under this draft will be considered after February 18 to make the final rules. Union Minister Ashwini Vaishnav has also written a post on social media X and sought advice from the people regarding the draft DPDP rules. Let us tell you today what is there in the draft of DPDP…

Approval will have to be taken before transferring data

According to this draft, now any company will have to take prior approval from the government to take any data related to Indian users out of the country. After the implementation of these new rules, now if a child wants to create a social media account of his own, he will first have to take permission from his parents for it. It is being told that to properly implement this rule, establishment of a Data Protection Board is also being considered. Which will work like a digital office. This board will have the power to investigate data breaches and thefts. It is being said that as soon as this rule comes into force, consent managers will have to register with the Data Protection Board.

Any irregularities in data will be clearly identified.

It is being said that as soon as the government implements these new rules, any irregularities being done with the data will also come to light. Once this is implemented, the situation regarding notices received by anyone, registration of consent manager, processing of personal data of children etc. will also become clear.

What is there in this draft of DPDP Act?

Under this draft, it has been said that in exercise of the power given by sub-sections one and two of section 40 of the DPDP Act 2023, the proposed rules will be made by the Central Government on or after the date of coming into force of the Act. The draft rules are published for the information of all users affected by them.

It is being said that this draft mentions that the person responsible for the data will have to make efforts to check that the person identifying himself as the parent of the child is an adult and is in compliance with any law applicable in India. Identifiable when necessary in relation to compliance. According to the draft rules, those responsible for the data will have to retain it only for the period for which consent has been provided and then delete it. It is being said that with the implementation of this rule, e-commerce, social media and gaming platforms will come under the category of responsible for data.
