AIMIM has made Tahir Hussain its candidate from Mustafabad.
A two-judge bench of the Supreme Court could not reach a consensus on the bail plea of Delhi riots accused and AIMIM candidate in the assembly elections, Tahir Hussain.
In the hearing held on Wednesday, Justice Ahsanuddin Amanullah was in favor of granting bail to Tahir, while Justice Pankaj Mittal rejected the petition. Now a bench of 3 judges will hear the bail.
While hearing the petition, Justice Amanullah also questioned the police who were opposing the grant of interim bail. He asked why the policemen were not able to interrogate the witnesses in the last 5 years.
Tahir Hussain, who has been in jail for 4 years and 9 months, has been made a candidate from Mustafabad by Owaisi’s party AIMIM for the Delhi Assembly elections. He has filed a bail petition in the Supreme Court only to contest Delhi elections.
Earlier, the case was also heard on January 20. In this, the Supreme Court had said that all the people in jail should be prevented from contesting elections.
On this, senior advocate Siddharth Aggarwal, appearing on behalf of Tahir, had requested a hearing from the court on January 21. Then Justice Mittal had said-
Now they contest elections sitting in jail. It is easy to win elections by sitting in jail. All of them should be stopped from contesting elections.
Tahir has been in judicial custody for more than 4 years and 9 months.
High Court had given custody parole for nomination
Tahir is accused of murdering IB officer Ankit Sharma on 25 February 2020 during the Delhi riots. Tahir had sought interim bail from the High Court from January 14 to February 9 for election campaign. On January 13, the High Court had said that nomination can be filed even from jail.
On this, Tahir’s lawyer Tara Narula argued that Engineer Rashid was granted interim bail for election campaign. A case of terror funding is also going on against him.
Tahir has been made a candidate by a national party. They are ready to give details of all their assets. He also has to find a proposer for himself and the election process has started in Delhi.
The trial in the case has started and so far 20 out of 114 witnesses have been examined. In such a situation, the trial is not expected to be completed soon. Tahir has been in custody for more than 4 years and 9 months.
The High Court had approved Tahir’s custody parole on January 14. On January 16, Tahir came out of Tihar jail amid tight security and went back to jail after filing nomination. After this Tahir reached the Supreme Court for bail.
On 24 February 2020, 53 people were killed and more than 250 were injured in the riots in North-East Delhi.
Allegation of use of licensed pistol in riots
In the Delhi riots case, the Crime Branch had filed two charge sheets in the Karkardooma court. The first case was related to Chand Bagh violence and the second case was related to Jafrabad riots. Police had described Tahir Hussain as the mastermind in the Chand Bagh violence case.
Apart from Tahir, 15 people including his brother Shah Alam were made accused. In the charge sheet, Delhi Police had said that at the time of the violence, Tahir Hussain was on the terrace of his house and it was because of him that the violence had erupted.
Tahir had used his licensed pistol in the riot. According to the police, Hussain had taken out his pistol stored at Khajuri Khas police station just a day before the riots. The police had seized the pistol during the investigation.
