The Home Ministry has given approval to the Enforcement Directorate (ED) to file a money laundering case against AAP convener Arvind Kejriwal. Delhi LG Vinay Saxena has also given permission to prosecute Kejriwal.
ED had to take this approval because the Supreme Court had said that this would have to be done to prosecute government employees. ED had filed a charge sheet against Kejriwal in the PMLA court last year. In this, Kejriwal was made an accused in the liquor policy scam.
ED has received this approval at a time when assembly elections are to be held in Delhi on 5th February. The results will come on 8 February.
Delhi LG VK Saxena on Saturday gave permission to the Enforcement Directorate (ED) to prosecute Arvind Kejriwal in the liquor policy matter. On December 5, ED had sought permission from LG to conduct trial against Kejriwal.
The charge sheet was filed in the trial court in July, the entire case in 4 points.
- ED had filed the 7th charge sheet against Kejriwal in the trial court. Taking cognizance of the charge sheet on July 9, the trial court had said – there is enough evidence to prosecute the case against Kejriwal.
- In November, Kejriwal had sought quashing of the trial court’s order taking cognizance of the ED’s 7th charge sheet in the Delhi High Court. He had said that at the time of the allegations made by ED, he was a public servant.
- Was handling the responsibility of Chief Minister of Delhi. ED did not have the necessary approval to run the case. Despite this, the trial court took action on the charge sheet.
- After Kejriwal’s demand was rejected by the High Court, Kejriwal reached the Supreme Court. Where the court ruled in his favor. The Supreme Court said that government permission is necessary to run the case.
- After this, the Supreme Court, while giving its verdict on November 6, had said that a case cannot be prosecuted against a public servant under the sections of Money Laundering (PMLA) without the permission of the government. This rule will also apply to CBI and State Police. After this ED sought permission from the Governor.
Liquor Policy Case- Kejriwal has spent 156 days in jail
Kejriwal was arrested by ED on March 21. After 10 days of interrogation, he was sent to Tihar Jail on 1 April. On May 10, he was released for 21 days to campaign in the Lok Sabha elections. He was released after spending 51 days in jail. On June 2, Kejriwal surrendered in Tihar Jail. After this, he got bail from the Supreme Court on 13 September. He spent 156 days in jail.
Assembly elections in Delhi in next 2 months The current tenure of Delhi Assembly ends on 23 February 2025. Elections may be held in the next two months. The last assembly elections were held in February 2020, in which the Aam Aadmi Party won an absolute majority and 62 out of 70 seats.
