State Bureau, Naiduniya, Bhopal. The Jabalpur High Court on Tuesday canceled the petition challenging the 27 percent OBC (Other Backward Classes) reservation of Youth for Equality Association. With this, 13 percent posts will be recruited.
What will be its process, from which class OBC or general will be recruited, the government will decide on the decision of the High Court on the opinion of the Law and Legislative Department. Please tell that the case of giving 27 percent reservation to OBC has been stuck for five years.
Reservation in the state will be 63 percent
Reservation will be 63 percent in the state, including this reservation. By the way, in the Indira Sahni case, in the year 2009, the Constitution Bench has fixed the limit of reservation 50 percent.
The then Kamal Nath government of the state had increased the OBC reservation limit in government jobs from 14 to 27 percent by submitting amendment bill in the Assembly with the aim of taking advantage of the Lok Sabha elections in 2009. Due to this, reservation in the state increased to 63 percent.
Challenge was given in High Court
Prior to this, 20 percent for Scheduled Tribes category, 16 for Scheduled Castes and 14 percent for Other Backward Classes were 14 percent. Due to the reservation limit being more than 50 percent, it was challenged in the High Court and on 20 January 2020, 27 percent reservation was banned, since then the matter was stuck.
The recruitments were not happening. In view of this, the then Advocate General observed the General Administration Department on 26 August 2021 and informed the court that 13 percent posts would be stopped and appointed. On the order of GAD, two lists were made from September 2, 2021, for the remaining 13 percent.
One OBC and one unreserved class so that whenever a decision is made, it does not take much time to give appointments accordingly. Since then the same sequence was going on. Due to this formula, appointments for about five and a half thousand posts are stuck.
It also includes other posts of Employees Selection Board including 2,400 sub -ministers. Similarly, the posts of recruitment to be done through the State Public Service Commission have also been stopped. Additional Chief Secretary of General Administration Department Sanjay Dubey says that the order of the High Court has not been received yet.
Therefore it cannot be said, who will get appointment on the 13 percent posts for which appointments were stopped. On receiving the order, a policy decision will be taken from the government level after sending it to the law and legislative department.
