Naiduniya Representative, Jabalpur. The troubles of film actor Saif Ali Khan’s family are not showing any sign of abating. After Saif’s attack, the crisis on property worth crores has deepened. The long running dispute regarding his properties in Bhopal has further escalated.

In fact, the freezing order imposed by the High Court in 2015 on his immovable property situated in Bhopal district has been lifted. After this decision, the property of Saif Ali Khan’s family is in danger.

This crisis has deepened because the family has run out of chances to appeal. The district administration has now become free to subjugate these properties. However, the Saif family still has one more chance. They can file an appeal in the double bench of the High Court.

• This dispute started in the 1960s regarding Saif Ali Khan’s property located in Bhopal. When Nawab Hamidullah Khan died, his daughter Abida Sultan was considered entitled to the property. Abida had gone to Pakistan.
• After that, the Government of India issued an ordinance declaring his second daughter Sabia Sultan as the heiress of the Nawabi property of Bhopal. After this ordinance, fear spread among property buyers that these properties might be taken back by the Central Government.
• Saif Ali Khan had challenged the declaration of his properties as enemy property in 2014. He said that his property was not enemy property. The action of the Enemy Property Department in this case was wrong. This challenge made this whole controversy even more complicated.

Controversy after High Court order

• An important decision was taken in this matter after a recent hearing in the High Court. On December 13, the High Court rejected the petition of Saif Ali Khan, his mother Sharmila Tagore and Sabia Sultan.
• The court had given him the option to appeal to the Appellate Tribunal within 30 days, but the appeal was not filed within this time limit.
• As a result, the stay imposed by the High Court has now become ineffective. Bhopal district administration has now got the authority to subjugate these properties.

High Court order

• The High Court had earlier directed actresses Sharmila Tagore, Saif Ali Khan and Sabia Sultan to submit representations before the Central Government regarding enemy property in this case.
• The court had said that if the petitioners submit a representation to the Central Government within 30 days, then the Central Government will dispose of it appropriately. However, when the process could not be completed, the court dismissed the petition, putting the properties of Saif Ali Khan and his family in jeopardy.

What path forward does the family have?

• Saif Ali Khan’s family still has one more chance, as they can file an appeal in the double bench of the High Court. If they file an appeal and the court rules in their favor, the threat to their property may be lifted.
• Till now his properties are under threat. The district administration has got complete freedom to subjugate these properties.
• This case is important not only for Saif Ali Khan and his family but also for those who have bought properties from the Pataudi family. If these assets are subpoenaed, they could lead to legal problems.
