Atul Subhash’s mother Anju Devi had filed a Habeas Corpus petition in the Supreme Court for the custody of 4-year-old Vyom. On Tuesday, the Supreme Court told petitioner Anju Devi that the child (Vyom) is with the mother (Nikita). At the same time, the court has sought an affidavit from the Haryana government and Atul’s wife about the current condition of the child. Now the next hearing in the case will be on January 20.
What did Nikita’s lawyer say during the hearing in the Supreme Court?
In the hearing held in the Supreme Court, Nikita’s lawyer told that now the child is with Nikita. After getting bail on Saturday, she brought the child to herself from the school in Faridabad. Nikita has to appear before the investigating officer every Saturday. Therefore, she will go to Bengaluru with the child. Will get the child admitted in the same school.
The Supreme Court said that notice on this petition was issued because the mother was in custody. Now that it has come out, there is no point in hearing the Habeas Corpus petition filed to trace the child. Anyway the child is not in contact with his grandmother. Grandma is a stranger to him.
Vyom’s admission was done in the boarding school of Faridabad.
After Nikita got bail on Saturday, Atul Subhash’s brother Vikas Modi spoke to Dainik Bhaskar. Vikas had then told that ‘According to the information given by Bengaluru Police, Nikita Singhania has sent brother Atul’s 4-year-old son Vyom to ‘Satyug Darshan’ boarding school in Faridabad. Vyom was admitted to this school in January last year. At that time he was not even 4 years old. The signatures of parents are also blank in the forms submitted to the school. Atul Subhash’s name is also not recorded in the column of his brother and father in the form, whereas his brother’s name is recorded in the birth certificate.
He said, ‘The way my brother Atul Subhash had said in the video recorded before his suicide that his wife was using the child as a tool, I fear that even after coming out on bail, my son Vyom will be used. Will use it as a tool.
Anju Devi had claimed – We do not know where the grandson is.
Atul’s mother had filed a Habeas Corpus petition in the Supreme Court. It has been claimed that son Subhash’s wife Nikita and the arrested in-laws are not telling about the grandson. We do not have information about the grandson’s whereabouts at present.
At the same time, Nikita had told during the interrogation of Bengaluru Police that the son is in the custody of uncle Sushil Singhania. His name is registered in a boarding school in Faridabad. Here Sushil has said that he has no information about the child.
Will go to High Court against bail
Atul’s wife Nikita got bail last Saturday. After which Atul’s brother Pawan Modi said that ‘he will go to the High Court against the bail given by the Lower Court. If necessary, we will also go to the Supreme Court.
Bengaluru City Civil Court on Saturday granted bail to Nikita Singhania (wife of Atul Subhash), Nisha Singhania (mother-in-law) and Anurag Singhania (brother-in-law). After this, Atul Subhash’s brother Vikas Modi said, ‘We had given 15 objections opposing the bail, which were very strong grounds for opposing the bail. The biggest condition in the objection was that the investigation has still not been completed.
Vikas Modi said that ‘the lawyers handling his case had presented their views on 15 points before the court. Looks like those points were not seen. We have not received the copy of the decision yet. Will take a decision after receiving the copy. Will fight till my last breath to get justice for my brother.
