The Congress government of Telangana promised to increase the limit of reservation in its election promises.

Telangana CM Revanth Reddy announced in the Assembly on Monday that his government is going to increase the OBC (Other Backward Classes) reservation limit from 23% to 42% in the state.

If this is implemented, the reservation limit in the state will be 62%. This will be violated by the 50% reservation limit fixed by the Supreme Court.

Telangana CM said- New proposal for 42 percent reservation sent to Governor Telangana CM said in the assembly- Congress leader Rahul Gandhi had promised that if the Congress comes to power, OBC reservation would be increased to 42 percent. Soon after assuming power, our government began the caste census. Earlier, the Congress government had sent a proposal to the Governor to increase OBC reservation by 37 percent. This government is withdrawing the earlier proposal, now sending a new proposal of 42 percent reservation.

We will also take the necessary legal assistance to increase OBC reservation by 42 percent. We will not sit calm until 42 percent reservation for backward classes is obtained.

The proposal will pass, but violation of rules The Congress has 64 MLAs in the 117 -seat Telangana assembly. Therefore, the bill with OBC reservation will be passed in the assembly, but after its implementation, the limit of reservation in Telangana will reach 62%. This will be a violation of the 50% reservation limit determined by the Supreme Court.

The Reservation Amendment Bill 2023 passed in Bihar Legislative Assembly on 9 November 2023. In this, the scope of caste reservation was increased to 65%. The total reservation in Bihar was to be reduced to 75% in Bihar, including 10% quota of the economically weaker section. This was much higher than the maximum limit fixed for reservation, ie 50%.

High court stayed first, Supreme Court upheld The move was rejected by the Patna High Court in July 2024. At the same time, the Supreme Court refused to stay the High Court’s decision. The Supreme Court said that this step of the Bihar government will interfere in the right to equality given by the Constitution.
