Petition in Supreme Court to remove Tamil Nadu Governor: Claim- Governor is continuously violating the Constitution; It is not their duty to order the playing of the national anthem.

A petition has been filed in the Supreme Court for the removal of the Governor of Tamil Nadu. In which a demand has been made to direct the President’s Secretary and others to recall TN Ravi. The petition claims that Ravi has not performed the duties of the Governor and has repeatedly violated the Constitution.

Advocate CR Jaya Sukin, who filed the petition, said- The Governor left the Assembly without giving his traditional address on January 6. At the beginning of the address, the Governor had asked for playing the national anthem, whereas it is not his duty to give such an order.

In fact, on the first day of the Tamil Nadu Assembly session which started from January 6, the Governor had walked out without addressing. Which was opposed by the CM and other ministers of the state. Stalin had also said that this was childish and a violation of democratic traditions.

RN Ravi was made the Governor of Tamil Nadu in 2021. Since then, there have been disputes between the MK Stalin government of the state and him on many issues. The Stalin government alleges that the Governor is acting like a BJP spokesperson. They stop government bills.

The state anthem Tamil Thai Valthu is sung at the beginning of the proceedings of the House and the national anthem is sung at the end. But Governor Ravi objected to this rule and said that the national anthem should be sung both the times. Raj Bhavan issued a statement – ​​The Governor appealed to the House to sing the national anthem. But was refused. This is a matter of serious concern. Angered by the insult to the Constitution and the national anthem, the Governor left the House.

In February 2024, the Governor had refused to deliver the traditional address in the Assembly and had said that the draft contained several passages containing misleading claims which were far from the truth. Raj Bhavan had also said that the national anthem should be given due respect and played at the beginning and end of the Governor’s address. After the Governor left the House, Assembly Speaker M. Appavu gave the address to be read out by the Governor. .

Claims made in the petition regarding the Governor

  • Article 153 of the Constitution states that there shall be a Governor for each State and under Article 155, the President appoints the Governor. Article 163 of the Constitution states that there shall be a Council of Ministers to aid and advise the Governor.
  • It is not the duty of the Governor to order the playing of the national anthem first. Tamil Nadu Governor RN Ravi has now crossed and violated all the conditions of the Indian Constitution. The Governor’s traditional address to the Assembly at the beginning of the session is becoming an unpleasant event every year.
  • Since assuming the office of Governor of Tamil Nadu, he has made political comments ignoring the rules of conduct of the Governor’s office and has called the Dravidian governance model ‘a defunct ideology’.
  • The Governor has blocked many laws from being enacted by refusing to give his assent to the bills. On several occasions he has sent back bills or put them on hold.
  • The Supreme Court has also said earlier that the Governor cannot enter the political arena. They can only discharge the functions given in the Constitution.

Governor-Stalin dispute may reach Supreme Court even in 2023

The dispute between the Tamil Nadu Governor and the state government has also reached the Supreme Court in November 2023. Then a hearing was held in the case of stalling the Governor’s bill. The Tamil Nadu government had filed petitions complaining about not signing the bill.

The then CJI Chandrachud had said in the court – We saw that Governor Ravi did not give his approval on ten bills until we sent a notice to the Governor on the petition of the state government. These bills were pending for three years, what was the Governor doing for three years? Not taking action on the bills is a matter of serious concern.
