The Supreme Court has dismissed a petition filed against repeated release of Dera Sacha Sauda chief Gurmeet Ram Rahim on parole and furls. The court clarified that a public interest litigation cannot be filed by targeting a particular person.
,
If a rule has been violated or the orders of the High Court have not been followed, it can be challenged in the High Court. This petition was filed by the Shiromani Gurdwara Prabandhak Committee (SGPC). In the petition, Ram Rahim was opposed to allowing him to come out of jail repeatedly since 2022.
This petition was filed due to political rivalry- Mukul Rohatgi
The SGPC said that the Haryana government is continuously giving Ram Rahim a chance to stay out of jail by giving parole and furoons, which is a violation of the law. On behalf of Ram Rahim, senior advocate Mukul Rohatgi argued in the Supreme Court that this petition has been filed due to political rivalry.
Questioning the intention of SGPC, he said that when the petitioner calls himself a religious organization, how can he talk about political rivalry? On this, the SGPC counsel said that when Ram Rahim considers himself a religious person, why is he being accused of political malice?
Supreme Court comment
A bench of Supreme Court Justice Bhushan Ramakrishna Gawai and Justice Manoj Mishra said during the hearing of the case that the High Court had already clarified that the government could consider the demand of Parol as per rules.
The petitioner argued that last year Ram Rahim’s release was against the orders of the High Court. On this, the Supreme Court said that if this is the case, a contempt petition can be filed against the state government in the High Court, but it cannot be produced as a PIL in the Supreme Court.
Serious allegations and punishment on Ram Rahim
Gurmeet Ram Rahim has been sentenced for heinous crimes like murder and rape. In 2017, she was sentenced to 20 years in the case of rape from two women disciples. In addition, he was sentenced to life imprisonment in 2019 in the 2002 murder case of journalist Ramchandra Chhatrapati in 2002.
However, despite such serious crimes, the Haryana government has repeatedly given him a chance to come out of jail by giving him parole and furoons. Ram Rahim was also charged by the Haryana government in October 2022, January 2023 and July 2023, causing the matter to be in controversy.
Questions raised on the government’s parole policy
SGPC and other organizations allege that the Haryana government is releasing Ram Rahim for political gains. SGPC says that if there was a common prisoner, he would not get parole or furls so many times. However, the government is giving him a chance to come out of jail again and again to please Ram Rahim’s followers.
However, the government argues that all prisoners are given equal rights under the law, and the decision to give up is taken as per the jail rules.
