Nagpur bench of Bombay High Court gave its verdict in the case of abetment to suicide.
The Nagpur bench of the Bombay High Court on Wednesday gave its verdict in the case of inciting a woman to commit suicide. The court said- Just because the man ended the relationship and then the woman committed suicide, a case of abetment to suicide cannot be registered against the person.
Justice Urmila Joshi-Phalke acquitted a 26-year-old youth in a similar case. A case was registered against him for instigating a woman to commit suicide. With whom he was in a relationship for 9 years. He had challenged in the High Court the decision of Khamgaon Sessions Court of Buldhana district not to acquit him in this case.
The judge said- There is no evidence anywhere in the investigation that the man had instigated the deceased woman to commit suicide. Evidence has shown that even after the breakup, talks between the two continued. If the man had refused to marry her, it would not amount to inciting the woman to commit suicide.
Bench said – did not commit suicide immediately after breakup The bench said – Neither the suicide note nor the WhatsApp chat shows that the person had a physical relationship with the promise of marriage and after that their relationship broke. The deceased did not commit suicide immediately after the breakup.
He said that there was a breakup between the two in July 2020 itself while the deceased committed suicide on December 3, 2020. This means that there is no connection between breakup and suicide.
SC had said- Torture cannot be called incitement to suicide The Supreme Court had said in a case on December 10 that a person can be accused of instigating someone’s suicide only when there is strong evidence. Mere allegation of harassment is not enough for this. This comment was made by the bench of Vikram Nath and PB Varale during the hearing on a decision of the Gujarat High Court.
In fact, the Gujarat High Court had refused to acquit a woman’s husband and in-laws of harassing her and forcing her to commit suicide. After this, the Supreme Court overturned the decision of the Gujarat High Court and acquitted him of the charge of instigating the woman to commit suicide.
This comment of the Supreme Court came at a time when the case of suicide of 34-year-old IT engineer Atul Subhash in Bengaluru was in discussion. In a 24-page suicide note, Atul had accused his wife and her family members of harassing him and instigating him to commit suicide.
