The court’s verdict has come in the rape-murder case of a trainee doctor in RG Kar Medical College, Kolkata, the capital of West Bengal. Sealdah Court on Monday sentenced Sanjay Roy, convicted of rape and murder of a trainee doctor, to life imprisonment. A fine of Rs 50 thousand has also been imposed on him. Convict Sanjay Roy was sentenced for 164 days in the case. However, it refused to consider this case as the rarest of the rare. The court said, ‘This is not the rarest of rare case. Therefore death penalty cannot be given. At the same time, the local court ordered the state to pay compensation of Rs 17 lakh to the victim’s family, but the family refused to take it.
Sanjay was convicted on January 18
On January 18, the lower court had convicted Sanjay Roy in the RG tax case under sections 64, 66 and 103 (1) of the Indian Justice Code (BNS). He was declared guilty, but the decision on punishment was reserved. A 160 page decision has been written for Sanjay’s punishment.

What else did Sanjay Roy say before the punishment?
Before being sentenced in the case, Roy told the court, “I am being framed and I have not committed any crime.” I have not done anything yet I have been convicted. “I was beaten in jail and I was forced to sign papers,” he said.
CBI had demanded strict punishment
During the proceedings, the CBI advocate appealed to give the harshest punishment to the culprit. The agency’s lawyer told the court, “We request the harshest punishment to maintain people’s faith in the society.” Roy’s defense lawyer argued that the prosecution should present such evidence which can prove that there is no scope for the convict to reform.

The defense lawyer requested for ‘some alternative punishment other than death penalty’ to give convict Sanjay Roy a chance to reform. While the lawyer representing the aggrieved party sought strict punishment for the culprit, arguing, “Sanjay Roy, being a volunteer, was responsible for the security of the hospital, but he himself committed the heinous crime along with that trainee doctor, Whom it was his duty to protect.”
A trainee doctor was raped and murdered on the night of 8-9 August at RG Kar Medical College-Hospital in Kolkata. On the basis of CTV footage, the police arrested a civic volunteer named Sanjay Roy on August 10. There were protests across the country including Kolkata regarding this incident. In West Bengal, medical staff and doctors went on strike for more than 2 months, due to which health services were coming to a standstill.

Out of 3 accused, 2 got bail
In this case, CBI had made 2 people including Sanjay Roy accused. Sandeep Ghosh, former principal of RG Kar Medical College, and Abhijeet Mandal, former in-charge of the police station, were also made accused. But CBI could not file a charge sheet against Sandeep Ghosh within 90 days, on which he was granted bail on 13 December. Apart from this, Abhijeet Mandal was also granted bail for not filing the charge sheet.

A task force was formed to investigate the RG tax case. The task force arrested the culprit Sanjay Roy within 6 hours. The task force had found many evidences against Sanjay Roy from the crime scene. In the CCTV footage, he was seen entering the seminar hall and then leaving from there after some time. The task force had found a broken Bluetooth earphone from the seminar hall. It was connected to the accused’s phone. Along with this, traces of the victim’s blood were found on Sanjay Roy’s jeans and shoes. Sanjay Roy’s DNA matched the evidence found at the spot.

CBI filed the charge sheet in the Calcutta High Court on 7 October 2024. In this, Sanjay Roy was named the only accused. The investigating agency also said that the trainee doctor was not gang-raped. The CBI chargesheet included statements of 100 witnesses, 12 polygraph test reports, CCTV footage, forensic report, mobile call details and location.
