The Supreme Court on Tuesday heard the case related to detention centers. During this period, instead of sending 63 foreign declared people to their country, reprimanded for keeping them in dinten centers. Justice Abhay S Oak and Justice Ujjal Bhuiyan asked the Assam government if you are waiting for any Muhurta for it.
The Assam government claimed in the court that the exile of these people was not possible because they did not say which country they are from. The bench directed to send these people back in 14 days.
Questions from the government of the court
- You have refused to start the exile of the prisoners, saying that you do not know their addresses. Why should it be worried about it?
- You know their citizenship status. Then how can you wait till they get their address? This is to decide where they should go.
- Once a person declares a foreigner, the next logical step has to be taken. They cannot be kept in custody for eternity.
- Assam has several foreign custody centers. How many people have you deported? Tell me by giving affidavits in two weeks.
Notice to central government, sought reply in 1 month
The Supreme Court has also issued a notice to the Government of India. The court said- the government will have to tell how such cases are to be dealt with, because they are neither Indian citizens nor their real citizenship. We give the government a month to file an affidavit.
The court said- The government should also keep details of the declared foreigners who are not Indian citizens. And the details of those who have been reported so far. Details should also be given about the methods of their sub -departation. Also share information about data.
Instructions for Assam government to form an inquiry committee
The bench said during the hearing- It is the responsibility of the state government to have all the facilities in detention centers. Also, state government officials should also form a committee which will visit Transit Camp/ Detention Centers once every 15 days. It will also decide that proper facilities are available there.
