The Supreme Court said that the daughter has every right to recover the expenses of her education from her parents.
The Supreme Court said in one of its orders on Thursday that daughters have every right to demand education related expenses from their parents. If necessary, parents can be legally forced to pay the required amount for their daughter’s education.
The court gave this order in the case of a couple living separately for 26 years. The couple’s daughter was studying in Ireland. The maintenance allowance given by the father to the mother was Rs 43 lakh for the daughter’s education, which the daughter refused to take citing her self-respect.
The bench of Justice Surya Kant and Justice Ujjwal Bhuiyan said – the daughter has the right to keep this money. He does not need to return this money to his mother or father. She can spend it however she wants.
There was a settlement of Rs 73 lakh between husband and wife. A settlement was reached between the couple on 28 November 2024, which was also signed by the daughter. Under this settlement, the husband had agreed to give a total of Rs 73 lakh to his wife and daughter. Out of this, Rs 43 lakh was for the daughter’s education. The rest were for the wife.
The court said that the wife has received her share of Rs 30 lakh and both the parties have been living separately for the last 26 years, hence there is no reason why the couple should not be divorced by mutual consent.
The bench said that the daughter refused to take the money to maintain her dignity. He asked his father to take the money back, but his father also refused. The father gave the money without any reason, which shows that he is financially strong and is capable of financially supporting his daughter’s education.
Court ordered – husband and wife will accept the terms of settlement The court ordered that as per this settlement, the husband and wife will not file any case against each other and if there is any case pending before any forum, it will be settled under the settlement. In future, both the parties will not make any claims against each other and will abide by the terms of the settlement.
