The Supreme Court has expressed displeasure over the Bangladeshi intruders being kept in jail for a long time. The Supreme Court has sought answers from the Central Government and West Bengal in this case. The Supreme Court has asked why these intruders are not being sent back to their country. These comments have been made by the Supreme Court on a public interest litigation of a group advocating these intruders.
What did the Supreme Court say?
The bench of Justice JB Pardiwala and Justice R Mahadevan in the Supreme Court heard the petition on 30 January. The Supreme Court said, “We want to understand that once the intruder from Bangladesh is convicted for a crime, does it not prove that he is not an Indian?”

He said, “There is only one confusion in our mind that once an intruder is prosecuted and convicted, then what is the need of verification of his citizenship from the Ministry of External Affairs.”

The Supreme Court asked that when the Ministry of Home Affairs made a rule to identify the intruders within 30 days in 2009, then why is it not being implemented now. He has also raised questions on the delay in sending them back. The Supreme Court has asked the Central Government to give a fresh figure of Bangladeshi infiltrators currently in jails.
NGO has filed a petition
All these comments were filed by the Supreme Court by the NGO named Commonwealth Human Right Initiative (Chri) Public interest litigation But Chri first filed this petition in the Calcutta High Court in 2011. This petition said that the status of Bangladeshi infiltrators in jails is pathetic and the state and central government are sitting hand in hand in their matters.
Chri had said that even after the sentence of these intruders was completed, they are not being sent back to their country. The notice was issued by the Calcutta High Court in this case. However, the Supreme Court, who petitioned him, came to see the action. After this, the hearing on it has started.
Significantly, for some time, the government and security agencies have been working fast to identify and send them back. In January itself, hundreds of Rohingya and Bangladeshi have been arrested in different parts of the country.
