Pastor Subhash Baghel of Chhindwara in Darbha block died on 7 January. Since then, his body is kept in Morchuri of Jagdalpur Medical College. His son Ramesh Baghel had filed a petition in the High Court and then in the Supreme Court to bury the dead body in the village or private land.

The hearing of the case for burial of the dead body was going on in the Supreme Court continuously. Meanwhile, the opinion of two judges came different. Justice Nagratna says that the body should be buried in private land. Whereas Justice Satish Chandra Sharma said that the Christian community has a separate cemetery 20-25 km away. The body should be buried there.

A situation of ruckus is being created in Bastar for burial of the dead body. In Jagdalpur district on December 30, there was a dispute over the death of the body after the death of a woman of the Christian community.

What did the court say in the final order?

Even after different opinions, the two judges did not send the case for the formation of a bench of three judges. In view of the sensitive matter, the final decision was issued using powers under Article 142.

In this final order, the court said that,

The body of the appellant’s father has been kept in the mortuary for the last three weeks, so we do not want to send the bench of the third judge. For the family of the deceased, a place in the cemetery located 20 km away should be decided. Along with this, all transport should be arranged to take the body from the mortgage and bury.

Let me tell you that pastor Subhash Baghel (65 years), a resident of Chhindwara village in Darbha block of Bastar district, died on 7 January 2025 due to some disease. After this, there was a ruckus about his bodies buried in the village. At the same time, his son Ramesh Baghel had kept the dead body in Morchuri at Medical College, Jagdalpur.

Seeing the dispute growing, the police force officials including the police force also reached the spot. After this, the son filed a petition in the High Court to bury his father’s body in the village itself. But his petition was rejected by the High Court. After which the son filed a petition in the Supreme Court.
