The Rouse Avenue Court of Delhi on Tuesday (March 11) directed to register an FIR against Aam Aadmi Party chief and former Chief Minister Arvind Kejriwal and other leaders. This FIR has been done on a complaint under the Delhi Property Prevention Act. In this, Kejriwal and his leaders were accused of misusing government money and putting their hoardings.
Hearing the court’s Acjm Neha Mittal, he said, “The complainant has shown prima facie that a cognizable offense has been committed.” The court said, “The severity of crime can be gauged from the fact that it is not only a knocking and public disturbance in the eyes, which is destroying the beauty spirit of the city, but also dangerous for the smooth flow of traffic.”
The court further said, “This (illegal hoardings) presents a security challenge for pedestrians and vehicles. The deaths due to the fall of illegal hoardings are not new in India. ” Now the next hearing of the case will be held on 18 March 2025. Along with this, the court has ordered the Delhi Police to file a compliance report on that day.
In fact, Shiv Kumar Saxena had demanded to register an FIR under Section 156 (3) of CRPC. He has said in his complaint that in the year 2019 CM Kejrival And the then AAP MLA Gulab Singh and the then AAP Corporation Councilor Nikita Sharma misused public money in Dwarka by putting up big size hoardings for the general public in intersections, roads, electric poles, DDA parks and other public places.
Saxena complained to the Delhi Police in this regard in this regard in 2019. However, if his complaint was not taken action, he turned to the court. At the same time, Delhi Police opposed this petition of Saxena in the court. Delhi Police told the court that the complaint was lodged in 2019 and no hoardings are currently displayed at that place. Therefore, there is no cognizable offense in it.
Delhi Police also told the court that the details of the printing press on the hoardings were not given. Therefore, it would be impossible to decide from where and at whom they were printed. The police also argued that in the complaint given by the complainant to the police station, about 8-10 people, including PM Narendra Modi, had accused, but most of the names were removed in the application filed in the court.
According to the complaint given to the police, a hoarding states that the Delhi government will start registration for darshan in Kartarpur Sahib, which has pictures and names of Kejriwal and Gulab Singh. Another hoarding wished Gurunanak Dev Jayanti and Kartik Purnima, which had a picture and name of Nikita Sharma. The complainant also cited another hoarding with pictures of Narendra Modi, Amit Shah, JP Nadda, Pravesh Verma and Ramesh Bidhuri.
After considering all things, the court said that banner board hanging or hoarding Property damage It is similar to transportation. The judge said that the police statement that no hoardings were found on the date of investigation, it seems to mislead the court. He also rejected the argument that the complainant had left the names of many people.
