Delhi High Court upheld the trial court’s order. The petition of the accused was rejected.
Delhi High Court said on Monday, ‘Speeches that brainwash the youth cannot be ignored.’ The bench of Justice Pratibha M Singh and Justice Amit Sharma made this comment in the case related to Unlawful Activities Prevention Act (UAPA).
The bench said – Speeches regarding brainwashing the youth and recruiting them for illegal activities against the country cannot be completely dismissed on the ground that no specific terrorist activity has been carried out.
In fact, under UAPA, Mohammad Abdul Rehman, accused in a terrorism-related case, was sentenced to 7 years and 5 months by the trial court in February 2023. He challenged the order in the High Court, which was rejected.
Mohammad Abdul Rehman was arrested on charges of being an associate of the Indian organization of terrorist organization Al-Qaeda. Many fake documents were found from him. This also includes fake passports. He had also come via Pakistan.
Rehman’s argument in the High Court was that even if he was convicted of terrorist activity and recruiting people, there was no evidence to prove that he had done anything like this.
The bench said-
The court said- Accused Mohammad Abdul Rehman was in contact with people associated with the Indian organization of Al-Qaeda. There were close relations between them. All of them were part of a big network. Therefore the decision of the trial court is upheld.
These are the allegations on the network
- make inflammatory speeches
- Distributing anti-religion and anti-India material
- Contact with terrorist organizations present in Pakistan
- Holding meetings with terrorist organizations,
- Recruiting, raising funds for terror group
- Spreading evil eye against India and its political leaders
The bench also said these things in the decision
- There is no need for hidden activity in such conspiracies, but declared terrorist organizations definitely get secret support.
- The plan to carry out terrorist activity can last for many years. The motive behind Section 18 of the UAPA is to address such preparations. Even if no terrorist activity took place.
- Terrorist organizations like Al-Qaeda work in a very secretive manner in the Indian subcontinent. Its accomplices often leave no evidence.
- In February 2023, the trial court convicted the appellant and other accused of conspiracy to commit acts which constitute preparation for committing a terrorist act.
